How probate works in New Jersey

General timeline

Probate and appointment (weeks 1-2). NJ's initial probate step is relatively fast. The executor presents the will to the county Surrogate, who can issue letters testamentary — often within days.

Creditor notice (6 months). Creditors have 6 months from the first publication of notice to file claims. The executor must also notify known creditors directly.

Inheritance tax clearance. NJ is one of six states with an inheritance tax. The estate cannot fully close without a tax clearance letter, which can take months to obtain.

Distribution (months 7-24+). NJ law generally prevents distribution until at least 6 months after the executor's appointment. Simple estates may close in 7-12 months. Complex estates commonly take 12-24 months.

New Jersey-specific considerations

Inheritance tax. NJ's inheritance tax rates depend on the beneficiary's relationship to the deceased. Class A beneficiaries (spouse, children, grandchildren, parents) are exempt. Class C (siblings) pay 11-16%. Class D (all others) pay 15-16%. NJ also has a separate estate tax for estates over $2 million.

Simplified probate. Estates under $50,000 (with no real estate) may qualify for simplified procedures using a small estate affidavit.
